§ 1. General Provisions

1. These Regulations define the rules for using the Online Store available at https://ariahair.pl, including rules for placing orders, concluding sales contracts, payments, delivery, the right to withdraw from the contract, and complaint procedures.

3. The Seller sells products available in the Store, particularly premium hair products and accessories related to hair extensions and care.

4. Contact with the Seller is possible via email at concierge@ariahair.pl and via WhatsApp at 734 636 262.

5. The Regulations are made available to Buyers free of charge on the Store's website in a manner that allows them to be recorded, downloaded, stored, and printed.

6. To use the Store, a device with Internet access, an active email account, and a web browser supporting cookies are required.

§ 2. Definitions

1. Store / Online Store – the internet service available at https://ariahair.pl.

2. Seller – Aria Hair Daria Anna Karczewska, ul. Księżnej Zofii 14, 78-200 Białogard, NIP: 6722114294, REGON: 544510406.

3. Buyer – a natural person, legal person, or organizational unit without legal personality, who uses the Store or enters into a Sales Agreement with the Seller.

4. Consumer – a natural person making a purchase in the Store for a purpose not directly related to their business or professional activity.

5. Entrepreneur with Consumer Rights – a natural person concluding a contract directly related to their business activity, if the content of this contract shows that it does not have a professional character for that person.

6. Product / Goods – a movable item available in the Store, which is the subject of the Sales Agreement.

7. Order – a declaration of will by the Buyer, made using the order form, directly aiming to conclude a Sales Agreement.

8. Sales Agreement – a contract for the sale of a Product concluded remotely between the Buyer and the Seller via the Store.

9. Working Days – days from Monday to Friday, excluding public holidays.

§ 3. Customer Account

1. Use of the Store can take place with a customer account or without registration, as a guest.

2. Creating an account is voluntary and free of charge.

3. To create an account, the Buyer provides the data required in the registration form, in particular an email address and password.

4. The Buyer is obliged to provide true, current, and factual data.

5. The Buyer is obliged to keep their account login data confidential.

6. The Seller may delete an account in the event of a gross violation of the Regulations by the Buyer, after prior request to cease violations.

§ 4. Placing Orders

1. Orders in the Store can be placed 24 hours a day, 7 days a week.

2. To place an Order, the Buyer should:

a) select a Product available in the Store,

b) add the Product to the cart,

c) complete the order form, providing the data necessary for Order fulfillment,

d) choose the delivery and payment method,

e) accept the Regulations,

f) click the button finalizing the Order with payment obligation.

3. Placing an Order by the Buyer constitutes an offer to conclude a Sales Agreement.

4. After placing an Order, the Seller sends the Buyer an email confirming receipt of the Order.

5. The Sales Agreement is concluded when the Seller confirms acceptance of the Order for processing.

6. The Seller reserves the right to verify the Order, especially in the case of high-value Orders or those raising justified doubts.

7. If the Order cannot be fulfilled, the Seller will inform the Buyer of this fact and propose a possible solution, including a refund of the payment made.

§ 5. Prices and Payments

1. Product prices displayed in the Store are gross prices and include the applicable VAT, if any.

2. Product prices do not include delivery costs, unless the Product description or information in the Store states otherwise.

3. The delivery cost is visible during the order placement, before its finalization.

4. The Buyer can make payments using methods available in the Store at the time of placing the Order, in particular via electronic payments, payment card, BLIK, online bank transfer, or other methods provided by the payment operator.

5. The Seller reserves the right to change Product prices, organize promotions and withdraw them, provided that these changes do not affect Orders placed before their introduction.

6. A sales document, if issued, may be sent to the Buyer electronically to the provided email address.

§ 6. Delivery

1. The Seller delivers within the territory of the Republic of Poland and to selected foreign countries, according to the delivery options available in the Store during order placement.

2. Product delivery is carried out by carriers or logistics operators available in the Store.

3. The order fulfillment time depends on Product availability, the chosen delivery method, and the country of delivery.

4. The estimated delivery time and delivery cost are presented to the Buyer during order placement.

5. The Seller informs the Buyer about the shipment of the Order via email or another available communication channel.

6. The Buyer should check the condition of the shipment upon receipt. In case of visible damage to the shipment, it is recommended to draw up a damage report with the carrier and contact the Seller.

§ 7. Right of Withdrawal from the Contract

1. The Consumer and Entrepreneur with consumer rights have the right to withdraw from a distance Sales Agreement within 14 days without giving any reason.

2. The withdrawal period expires after 14 days from the day on which the Buyer acquired possession of the Product or on which a third party indicated by the Buyer, other than the carrier, acquired possession of the Product.

3. To exercise the right of withdrawal, the Buyer should inform the Seller of their decision by means of an unequivocal statement sent to the email address: concierge@ariahair.pl or in writing to the address: ul. Księżnej Zofii 14, 78-200 Białogard.

4. The Buyer may use the withdrawal form attached at the end of these Regulations, but it is not obligatory.

5. To meet the deadline, it is sufficient to send the statement before its expiry.

6. In the event of withdrawal from the contract, the Seller shall refund to the Buyer all payments received, including the cost of the cheapest standard delivery offered in the Store, no later than 14 days from the day of receiving the statement of withdrawal from the contract.

7. The refund will be made using the same payment method as used by the Buyer, unless the Buyer explicitly agrees to a different solution.

8. The Seller may withhold the refund until receiving the Product back or until the Buyer provides proof of its return.

9. The Buyer should return the Product immediately, no later than 14 days from the day of informing the Seller about the withdrawal from the contract.

10. The direct costs of returning the Product are borne by the Buyer, unless the Seller informs otherwise.

11. The Buyer is liable for any diminished value of the Product resulting from its use beyond what is necessary to establish the nature, characteristics, and functioning of the Product.

12. The right of withdrawal from the contract may not apply in cases specified in Article 38 of the Consumer Rights Act, in particular with regard to non-prefabricated Products, manufactured to the Buyer's specifications or serving to satisfy their individualized needs.

13. For hygienic and health protection reasons, the right of withdrawal from the contract may not apply to Products delivered in sealed packaging, if the packaging has been opened after delivery, and the Product cannot be returned due to health protection or hygiene.

§ 8. Complaints

1. The Seller is responsible for the conformity of the Product with the contract in accordance with applicable legal provisions.

2. Complaints can be submitted electronically to: concierge@ariahair.pl or in writing to: Aria Hair Daria Anna Karczewska, ul. Księżnej Zofii 14, 78-200 Białogard.

3. The complaint should contain:

a) the Buyer's name and surname,

b) contact details,

c) Order number,

d) description of the non-conformity or defect of the Product,

e) the Buyer's request.

4. The Seller will consider the complaint within 14 calendar days from the date of its receipt.

5. The Buyer will be informed about the method of handling the complaint to the email address provided in the complaint notification.

§ 9. Personal Data

1. The administrator of Buyers' personal data is Aria Hair Daria Anna Karczewska, ul. Księżnej Zofii 14, 78-200 Białogard, email: concierge@ariahair.pl.

2. Buyers' personal data are processed for the purpose of order fulfillment, payment processing, delivery, contact with the Buyer, handling complaints and returns, maintaining accounting records, and asserting or defending claims.

3. The legal basis for data processing is, in particular, the performance of a contract, a legal obligation incumbent on the Seller, the Seller's legitimate interest, and the Buyer's consent, if granted.

4. Data recipients may include entities servicing the Store, payment service providers, courier companies, postal operators, accounting offices, IT service providers, and other entities, when required by law.

5. The Buyer has the right to access data, rectify data, delete data, restrict processing, transfer data, object, and lodge a complaint with the President of the Personal Data Protection Office.

6. Detailed information on personal data processing can be found in the Privacy Policy available in the Store.

§ 10. Cookies

1. The Store uses cookies to ensure the proper functioning of the site, remember user preferences, conduct statistics, and marketing activities, if the Buyer has given their consent.

2. The Buyer can change cookie settings in their web browser at any time.

3. Restricting the use of cookies may affect some functionalities of the Store.

4. Detailed information on cookies can be found in the Cookie Policy available in the Store.

§ 11. Intellectual Property

1. All content available in the Store, including texts, photos, graphics, logos, trade names, and visual elements, are protected by copyright or other intellectual property rights.

2. Copying, distributing, publishing, or using the content of the Store without the Seller's consent is prohibited, except in cases permitted by law.

§ 12. Provisions concerning Entrepreneurs

1. The provisions of this paragraph apply to Buyers who are not Consumers or Entrepreneurs with consumer rights.

2. In relation to entrepreneurs, the Seller's liability under warranty is excluded to the extent permitted by law.

3. The court having jurisdiction for resolving disputes between the Seller and an entrepreneur is the court having jurisdiction for the Seller's registered office.

§ 13. Out-of-court complaint resolution

1. The Consumer has the possibility to use out-of-court methods of complaint resolution and claim pursuit.

2. Information regarding out-of-court dispute resolution methods is available from municipal and district consumer ombudsmen, the Trade Inspection, and consumer organizations.

3. The Consumer may also use the ODR platform available at: https://ec.europa.eu/consumers/odr.

§ 14. Final Provisions

1. The Regulations come into force on the date indicated at the beginning of the document.

2. The Seller reserves the right to amend the Regulations for important reasons, in particular in the event of changes in law, changes in the operation of the Store, changes in payment methods, changes in delivery methods, or the need to adapt the Regulations to technical and legal requirements.

3. Changes to the Regulations do not affect Orders placed before the effective date of the changes.

4. Contracts concluded via the Store are concluded in Polish.

5. In matters not regulated by these Regulations, Polish law shall apply.

6. The court having jurisdiction for resolving disputes with Consumers is the court having jurisdiction in accordance with applicable legal provisions.
